In the recent New York decision, the judge cites a case in which the
FBI said they could unlock an iPhone 5 with iOS 8.1.2.  He then asked
them why they said they couldn't unlock one with iOS 7, their answer
was what you'd expect, and the judge found their assertions
"unreliable."
