(Not knowing that much about RIPA) but they don’t need to. 

For streaming, I imagine that the timing and the length of the packets is usually enough to identify the movie. Same as the oscillator leaking letting you know the channel. 

Once you accuse someone, it is their problem to pay up or deny.
