To start thing off: I AM _NOT_ A LAWYER

In general such a defense in the US would require the company reasonably
not know that its services are being used for illicit activity and the
company make an effort to stop and prevent the use of its services for
illegal activity. If you are marketing your product as a way to avoid
law enforcement, or if you know that a client us using your product for
illegal activity without reporting or at least blocking that client you
don't have much of a defense.
