Absolutely they recognize it.  And with this precedent in hand, they can go after all of them as well, provided they’re in the EU.  The whole point of this precedent is that, for the first time, it allows them to collect damages from parties who have no connection whatsoever with any infringement.  That’s why they’re so excited about it.

This isn’t about stopping piracy; study after study has shown that pirated music is more profitable than un-pirated music.  This is about collecting settlements from people unrelated to the piracy, who need to not be tied up in court for the rest of their lives.  Remember, in Germany, the loser pays all of the legal costs of both sides, in addition to damages, court costs, and penalties, so there’s no way that a copyright troll will ever _give up_ one of these cases…  they’ll just keep at it until the other side gives up or settles.  The house always wins.
