Actually, this is nothing new. The boys at the Bureau have a long
history of requesting data to which they have no genuine legal right of
access. Their original requests -- with few exceptions -- bank on
ignorance of due process.
In my time with Attrition.Org, especially during the heyday of the
Attrition defacement mirror (which definitely predated 9/11 and the
Patriot Act), we received a number of requests for all kinds of
information from federal LEOs. Our response was simple and consistent:
deliver to us a court subpoena for specific data and we will comply.
In all that time, we only got two or three subpoenas; none of
which were even fractionally as expansive as the original requests.
I've said it before and I'll say it again: anyone who gets such
requests should politely and firmly require a court subpoena and, if they
encounter any attempts at strong-arm tactics, retain an attorney who is
well-versed on high-technology and net-related law (someone like Jennifer
Granick...who happens to be my attorney <g>).
