
<!DOCTYPE html PUBLIC "-//W3C//DTD XHTML 1.0 Transitional//EN" "http://www.w3.org/TR/xhtml1/DTD/xhtml1-transitional.dtd"><html lang="de" xml:lang="en" xmlns="http://www.w3.org/1999/xhtml"><head><meta http-equiv="Content-Type" content="text/html; charset=UTF-8" /><title></title><style type="text/css">html,body{background-color:#fff;color:#333;line-height:1.4;font-family:sans-serif,Arial,Verdana,Trebuchet MS;}</style></head><body><p style="margin-bottom: 0cm;">Dear friends of the moon,<br><br>I am dedicated to the topic of human reproductive rights and especially to the topic of private human sperm donations. In Germany we do have a problem with colliding (informal and legal) rights in the field of pdeudonymous private sperm donations.<br><br>I. Essentials<br><br>For a possible solution of the problem I want to underline two things:<br><br>1. The possible right of a sperm donor to donate private AND pseudonymous and stay pseudonymous is not called into question.<br>2. The possible right of a human being to know who its direct biolocical ancestors are – and the need to get answers for its identity - is not called into question.<br><br>To make it more human and avoid an abstract discussion I produce an example.<br><br>II. Pseudonymity<br><br>Even anounymous ment private sperm donations are pseudonymous! Through DNA testing and DNA databases – and other databases - it is possible to find a biolocical relationship between sperm donor and the person who was created through the sperm donors donation. Even if the sperm donor and/or the person who was created through the sperm donors donation is not in any DNA databases. (Through the DNA of other related persons in these databases.)<br><br>In this fact lays another problem: How to hide your own identity, when you cannot hide your DNA? But for the initial problem it should not concern us!<br><br>III. Example<br><br>X is a media activist and dissident. Through different actions, like leaks and media coverage, a feud between X and government officials of his country is escalating. As X is part of an street demonstration he is isolated by government forces, abducted and mocked in a fake execution. Afterwards he is thrown out in a desert – and after a few days a legal death sentence is published. Some government officials are swearing to kill X and all his family, friends and descendants. And this is the true will of these government officials.<br><br>X is fleeing to Germany. And is doing underground media work against his home country regime. After a few years of hiding X wants to have biological descentants. But he wants to protect his descentants by getting abducted or killed through his home country government officials. If the child is a hostage, for X it wouln't be possible to continue his media work. Because he would be blackmailed: "If you continue (to work agains us), your decendant is dead!"<br><br>So X is doing a pseudonymous private sperm donation for a female, Z. A child, Y, is born through the donation. Z do not know who X is. In the process of donation there was no data exchanged at all. (Just the DNS.)<br><br>X – Donor<br>Y – Child<br>Z – Parent(s)<br><br>After some years the person, who was created through X' sperm donation, Z, wants to know who its acestors are/were.<br><br>IV – Present attempts<br><br>In the case of a pregnant women or in (some) cases of donors, a set of data about the ancestor is stored centralized by the german government. These centralized data can be corrupted – f.E. leaked by a corrupt german lawyer or german government official. Also the data could be stolen.<br><br>In the age of 16 the now self-responsible child can access the set of data. The child could bring itsef and/or the donor in danger by exposing the identity of the donor.<br><br>V. Thoughts about solutions<br><br>The set of data can't contain data of the residence of the donor.<br><br>a. The set of data could be stored centralized – with a warning - by the parent(s). But in this case the set of data could be gone lost by an accident or a bad decission by the parent(s). Also the child could gain access before it is "self-responsible" or in the age of 16. And other persons could gain acces to the set of data.<br><br>b. The set of data could be stored decentralized. F.E. through a blockchain system. But in this case the assess to the set of data could be gone lost by an accident or a bad decission by the parent(s). If the set of data is just the name, birthday, place of birth and the private history of the donor, often this isn't satisfying for the child. A decentralized communication channel should be available.<br><br>Basically you could create a token on a blockchain which is time locked for a maximum of 16 years. And just with this token you could get access to the set of data. But the problem here is, for the child(ren) the parents (Z) are often no trusted parties. And the then-self-responsible child (Z) itself could lost the token or trash the token in a bad choice moment. Maybe it is okay to slash token for bad behaviour, but in case of the own identity losing this token forever is not an option!<br><br>VI. Questions<br><br>Another party could control somehow that the child could get access with another token, after the original token was lost. But how could you design that? And sometimes it is nesseccary that the child get access before the locked time is running out. Do you have an idea how to handle that?<br><br>The search for the own identity is not bound by strict rules, and it is not stricly starting with the age of 16. What can be done to handle it more flexible? And how could you signal future events – f.E. the death of the donor?<br><br>VII. Informal Sippenhaft / collective punishment<br><br>Informal collective punishment in relation with ancestry/DNA and egg cell and sperm cell donations is a big thing in present and future. One example is the (informal) collective punishment in the ucranian-russian war. In this war topics like sperm and egg cell donations are brought up and are exististing.<br><br>It is important to protect privacy and to protect the choice to form the own identity without any danger.</p>
